Terms of Service

1. Agreement & Eligibility

By accessing or using HAID, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use HAID.

Eligibility requirements:

  • You must be at least 13 years old to use HAID
  • If you are between 13 and 17, you represent that you have parental or guardian consent
  • You must provide accurate and complete registration information
  • You may only have one account

2. Account Responsibilities

When you create an account, you agree to:

  • Keep your login credentials secure and confidential
  • Be responsible for all activity that occurs under your account
  • Notify us immediately if you suspect unauthorized access
  • Not share your account with others

We may suspend accounts if we detect suspicious activity or violations of these terms.

3. Health Disclaimer

HAID IS A HEALTH COMPANION, NOT A MEDICAL DEVICE

HAID does not provide medical advice, diagnosis, or treatment. The information displayed—including heart rate, HRV, sleep data, and activity metrics—is for informational purposes only.

Important:

  • Always consult a qualified healthcare provider before starting any exercise program or making health decisions
  • Do not disregard professional medical advice based on information from HAID
  • If you experience pain, discomfort, or concerning symptoms, stop exercising and seek medical attention immediately
  • HAID is not a substitute for professional medical care

Data from wearable devices and integrations are estimates and may not be accurate. Treat all metrics as general guidance, not medical facts.

By using HAID, you acknowledge that you understand and accept these limitations.

4. User Content

Your ownership: You retain ownership of the content you create, including activities, photos, and comments.

License to HAID: By posting content, you grant HAID a non-exclusive, worldwide, royalty-free license to use, display, store, and process your content to provide and improve our services.

License terms:

  • The license is necessary for us to operate the service
  • The license ends when you delete your content (except for backups and legal requirements)
  • You may delete your content at any time through the app

Your responsibilities:

  • You confirm you have the rights to post the content you share
  • You will not post content that infringes others' rights
  • You are solely responsible for your content

5. Acceptable Use

You agree NOT to:

  • Violate any laws or regulations
  • Post harmful, abusive, threatening, or offensive content
  • Harass, bully, or intimidate other users
  • Impersonate others or create fake accounts
  • Use automated tools to scrape, crawl, or access HAID without permission
  • Attempt to hack, reverse engineer, or compromise HAID's security
  • Use HAID for commercial purposes without our written permission
  • Interfere with other users' enjoyment of the service
  • Upload viruses or malicious code

We reserve the right to remove content and suspend or terminate accounts that violate these rules, at our sole discretion.

6. Subscriptions & Payments

Free Tier

  • Basic features with advertisements
  • May have usage limitations

Premium Subscriptions

  • Ad-free experience
  • Additional features
  • Billed monthly or annually

App Store / Play Store Purchases

If you subscribe through the Apple App Store or Google Play Store:

  • Apple or Google processes payments and manages billing
  • To cancel, use your device's subscription settings
  • Refunds are subject to Apple's or Google's policies
  • Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date

Direct Payments

If you subscribe through our website:

  • Payments are processed by secure payment providers
  • To cancel, use HAID account settings or contact support
  • Refunds: Pro-rata refund within 14 days for EU/UK consumers; evaluated case-by-case otherwise
  • Subscriptions auto-renew unless cancelled before the renewal date

Price Changes

We may change subscription prices with at least 30 days notice. Price changes apply at your next renewal period, not during your current subscription.

7. Third-Party Integrations

HAID connects to third-party services including:

  • Apple HealthKit
  • Google Fit / Health Connect
  • Garmin Connect
  • Fitbit
  • Polar
  • Amazfit
  • Other platforms as added

Important:

  • Each integration requires your explicit authorization
  • Third-party services are governed by their own terms and privacy policies
  • We are not responsible for the availability or accuracy of third-party services
  • You can disconnect integrations at any time in app settings

8. Intellectual Property

HAID's ownership:

  • The HAID name, logo, and branding are trademarks of APUAMA TECNOLOGIA LTDA
  • The app design, code, and features are our intellectual property
  • You may not copy, modify, or distribute HAID without permission

Feedback:

  • If you provide suggestions or feedback, we may use it to improve HAID without compensation or attribution

9. Disclaimers

HAID IS PROVIDED "AS IS" AND "AS AVAILABLE"

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

We do not warrant that:

  • The service will be uninterrupted or error-free
  • Data from integrations will be accurate or complete
  • The app will meet your specific requirements
  • Defects will be corrected

Your use of HAID is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability is limited to the greater of: (a) the amount you paid us in the 12 months before the claim, or (b) $50 USD

These limitations apply regardless of the theory of liability (contract, tort, negligence, or otherwise).

Important: Some jurisdictions do not allow the exclusion or limitation of liability. In those cases, your local consumer protection laws apply.

11. Termination

By You

  • You may delete your account at any time in app settings
  • To cancel subscriptions, use App Store/Play Store settings or contact us
  • Upon deletion, your data will be removed within 30 days per our Privacy Policy

By Us

  • We may suspend or terminate your account for violations of these terms
  • We may discontinue HAID with 30 days notice
  • Upon termination, your license to use HAID ends immediately

12. Disputes & Governing Law

These Terms are governed by the laws of Brazil.

Disputes will be resolved in the courts of São Paulo, SP, Brazil.

Exceptions:

  • EU/UK consumers retain rights under local consumer protection laws and may bring claims in local courts
  • US users agree to attempt informal resolution before legal action

13. General Provisions

Changes to Terms: We may update these Terms. For material changes, we will provide 30 days notice via email or in-app notification. Your continued use after changes constitutes acceptance.

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the complete agreement between you and HAID.

No Waiver: Our failure to enforce any provision does not waive our right to enforce it later.

Assignment: We may assign these Terms to a successor. You may not assign your rights without our written consent.
